GCR 2021: Finnish economics in competition law: a tale of Phase II merger reviews

Copenhagen Economics has interviewed the Finnish Competition and Consumer Authority (FCCA) and several prominent competition law practitioners for the chapter on Finland. The findings categorically illustrate how Phase II merger reviews have continued to dominate the field of economics of competition law in Finland.

Our research noted two key developments in merger investigations: 

  • The February 2020 merger between two grocery wholesalers was, in accordance with the FCCA’s proposal, barred by the Market Court, thus marking the first time a merger has been prohibited in Finland.
  • Many of the recent merger reviews have been detailed and data-intensive, increasing the duration and scale of the FCCA’s review processes. In contrast, the number of major cartel and abuse of dominance cases in Finland has remained moderate.
