HISTORIC JUDGEMENT FROM THE SWEDISH PATENT AND MARKET COURT OF APPEAL

On 24 November, the Patent and Market Court of Appeal dismissed an appeal brought by the Swedish Competition Authority, allowing the merger between pre-insulated pipe producers Logstor and Powerpipe to go through.

This decision is historic because it is the first time in 18 years that an appellate court have ruled on a merger case in Sweden. Also, it is the first substantive judgement on a competition matter from the newly formed Patent and Market Court of Appeal.

The court was primarily concerned with how the relevant geographic market should be defined, and the judgement confirmed that the geographic market was wider than Sweden, consisting of the EEA area and Switzerland.

Copenhagen Economics assisted the merging parties throughout the merger review, and Karl Lundvall and Martin Sutinen both testified as expert economic witnesses in court.
